Pursuant to California Lemon Law, the Song-Beverly Consumer Warranty Act, automakers (i.e. car companies) are required to repair vehicles under warranty within a reasonable number of repair attempts. If they can't do that, or are unable or unwilling, to do so then per California Lemon Law they are required to either replace or repurchase the defective vehicle (otherwise known as a "lemon").
You may be wondering what constitutes a "reasonable number of repair attempts." This number can vary based on the type of defect and the specific circumstances, and it is something that our lemon law attorneys can determine during a free consultation.
However, there are some "rules of thumb" which can create a legal presumption that you do in fact have a lemon and are entitled to relief. For example, in some circumstances if the car company makes as few as two repair attempts then there may be a legal presumption that the car is a "lemon." The car may be considered a "lemon" if any of the following occur within the first 18 months or 18,000 miles on the odometer, whichever comes first:
A) Two or more repair attempts are made for a safety-related concern;
B) Four or more repair attempts are made for any substantial concern; OR
C) The car spends 30 total days in the shop by reason of repair attempts.
